Customer Terms of Use

These Terms and Conditions govern any transactions between Customer (“Customer”, “Seller”, “Buyer”, “you”, etc) and Coinex, a California DBA, (“Coinex”, “we”, “our”, “us”, etc.). and supersede any oral or written statement made by Coinex or any agent of Coinex prior to this transaction. Customer shall not rely on any statement that is inconsistent with these Terms and Conditions.

1. Representations.
Customer represents and warrants the following to Coinex: (a) that Customer possesses the necessary knowledge, experience and financial resources to choose to purchase numismatic items from Coinex, without reliance on any statement or information from Coinex; (b) Customer has full legal authority to make this purchase from Coinex without notice to, or consent from, any third party; (c) Customer’s performance of Customer’s obligations under this Agreement do not conflict with any laws, regulations, contracts, or orders to which Customer may be bound. Customer agrees to indemnify and hold Coinex harmless from any costs, losses or damages (including attorney’s fees) in the event of a breach or alleged breach of any of these representations or warranties.
Further, Customer represents and warrants to Coinex that if selling numismatic items (a) Customer is the legal owner of and has full right, title and interest in and to the numismatic items as Customer’s separate property free and clear of all liens and encumbrances; (b) Seller has the full right and authority to sell the numismatic items to Coinex, without anyone’s consent or concurrence; and (c) the Property is genuine and authentic numismatic material.

2. Grading & Authenticity/Investment Advice.
Many numismatic items are graded and authenticated by third party services. However, certification does not eliminate market risk nor guarantee associated risk with the grading of numismatic items.
Coinex does not give any investment advice and/or guarantee profits and you shall be solely responsible for making any decision to purchase numismatic items. Customer acknowledges that the rare coin market is speculative, unregulated and volatile, and that coin prices may rise or fall over time. Coinex does not guarantee that any Customer buying for investment purposes will be able to sell for a profit in the future.
Past performance is not a guarantee of future performance. In making any decision to buy numismatic items you should view such decision strictly in context of purchasing such numismatic items as collector coins and any investment advice should be obtained by your own financial expert.
Coinex expressly disclaims any other warranties with respect to numismatic items or other items, express or implied, including the implied warranties of merchantability and fitness for a particular purpose.

3. Selling to Coinex.
Seller must send Coinex numismatic items for prior inspection. Coinex will not purchase numismatic items sight unseen. Upon Customer’s acceptance of sight-seen offer by Coinex, Seller will be paid in full by either: (a) check; (b) bank wire; (c) credit on account with Coinex against balance due; (d) any combination of the above.
Unless otherwise negotiated Coinex will make payment in full within 7 business days upon Customer’s acceptance of offer.
Coinex does offer insurance for up to $75,000 for any one package through its private insurance policy, however, Seller MUST send numismatic items according to the policy outlined below, in order to receive the coverage:
Shipments MUST be made via Federal Express and the property MUST be secured in the following manner: (a) The item must be packaged within a box provided by the Seller of the item and sent within a second box provided by Federal Express (a box within a box). (b) The package MUST be addressed to CNEX without any reference to the potentially rare and/or valuable nature of the contents (c) the package CANNOT be sent on a Friday, or on the last working day before public holiday.
If Seller in unwilling or unable to send numismatic items for prior inspection, Coinex may, at its own discretion, attempt to arrange a suitable workaround such as (a) escrow via lawyers where the expense is to be born by Seller or (b) arrange a meeting in person. No guarantee is made that Coinex will be able to accommodate such an arrangement.

4. Return/Refund Policy.
Customer has the right to return numismatic items purchased from Coinex within 72 hours of signed receipt of package date, except for (a) numismatic items removed from their original packaging; (b) any order where Coinex does not receive payment within 14 days of the invoice date or (c) unless otherwise stated in writing, including email) or mutually agreed upon prior to sale.
In addition, Customer must make all attempts to notify Coinex of the intention to return through phone at 888-726-4639 or via email at orders@chinesecoins.com in order for Coinex to process the return.
Customer agrees to return items via Federal Express in an unmarked box with packaging materials along with prepaid Federal Express label provided by Coinex to ensure they arrive in the same condition as delivered. Items need to be secured so as to eliminate movement in transit that may affect the condition and consequently the value of items. Federal Express packages need to be securely deposited with a Federal Express employee at a Federal Express Office location. The package CANNOT be sent on a Friday, or on the last working day before public holiday.
DAMAGE OR LOSS IN TRANSIT. For returns or refunds, Customer agrees that Coinex is not responsible for damage or loss whatsoever occurring during transit to Coinex’s facility. The risk of damage or loss during transit is entirely upon the Customer. If you wish to control your risk of damage or loss by transit, you should make arrangements to return your numismatic items directly at Coinex’s facility.
In the event that a package has not been delivered by Federal Express, Coinex will not be able refund or reship the purchased product until the appropriate carrier has notified Coinex in writing that said package has been declared lost. At that point in time Coinex will, at our discretion, either replace the product in full or part or refund the full purchase price.
If Coinex is unable to sell a coin to a Customer as expected even if payment has been received from Customer, Coinex reserves the right to cancel transaction and refund Customer. In no event shall Coinex’s liability to Customer for any reason whatsoever exceed refund or replacement of the coin in question, and Coinex disclaims any indirect, special, incidental, or consequential losses or damages arising in any manner from any transaction between Customer and Coinex.

5. Domestic Shipping.
Coinex currently ships numismatic items to locations within the United States and U.S. territories, including Alaska, Hawaii, Puerto Rico, Guam, and the US Virgin Islands.
All packages shipped to Customer are insured by Coinex and will be sent in unmarked packages unless required by statute, or common law decreeing that a declaration must be made to assist in identifying the contents. If a shipment is lost or damaged during transit, at Coinex, will replace the items or refund Customer’s purchase price. Customer much take photos of damaged items immediately upon receipt and notify Coinex at orders@chinesecoins.com or via phone, 800-472-6467.
Coinex bears the risk of loss until the shipment is delivered to Customer’s shipping address subject to the following: (a) Any variance in the Customer’s order, including discrepancies or defects, must be reported to Coinex within (5) days of receipt of shipment to make claims of loss; (b) Customer must retain all original packaging materials intact; and (c) Customer must cooperate with Coinex including providing supporting declarations regarding any loss.
Shipping times and schedules are affected by many factors beyond Coinex’s control and may change without prior notice. Coinex makes no guarantees, express or implied, with regard to delivery and shipping times, except when and where required by law. In the event of any lost or damaged shipment, Coinex will, as elected in Coinex’s sole discretion, either replace the order as originally confirmed, or refund the customer’s purchase price.

6. International Shipping.
Coinex currently ships numismatic items worldwide. The risk of loss and title for all merchandise ordered pass to you when the merchandise is delivered to the shipping carrier.
Irrespective of how imported goods arrive in the receiving Country, Customer is responsible for lodging any formal Customs Import Declarations if value is greater than $1000 (local currency). Customer shall pay any associated duty or taxes. Goods arriving in Country will be subject to Customs controls beyond the control of Coinex. Coinex has no responsibility for item once item is shipped and tracking number issued.
Certain goods brought into a Country may be prohibited, restricted or require an import permit. Customs might seize or detain such goods pending presentation of a permit. Customer is responsible for showing any required permit/clearance paper.
Coinex is responsible for shipment of item only, and the package may be marked for customs, and shipping/insurance fees at origination.
INTERNATIONAL RETURN POLICY: Customer shall pay ALL shipping costs for international purchases. Coinex must be notified within 72 hours.

Coinex makes no guarantees, express or implied, with regard to delivery and shipping times, except when and where required by law. In the event of any lost or damaged shipment, Coinex will, as elected in Coinex’s sole discretion, either replace the order as originally confirmed, or refund the customer’s purchase price.

7. Miscellaneous.
This Agreement contains all of the understandings and agreements between the parties with respect to the subject matter hereof and may be amended only by a writing signed by both parties.
This Agreement shall be governed by and construed in accordance with the laws of the State of California, excluding choice of law rules. Customer agrees that any legal action with respect to this transaction is barred unless commenced within one (1) year of the invoice date in a state or federal court located in Contra Costa County, California. Customer (a) consents to the exclusive jurisdiction and venue of these courts; (b) waives any right to trial by jury in any such proceeding; and (c) agrees that the prevailing party in any action shall be entitled to recover its costs, including attorney’s fees, from the non-prevailing party.
This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective permitted successors and assigns. Coinex may assign its rights and/or obligations hereunder in its sole discretion. Customer may not assign its rights and/or obligations hereunder without the prior written consent of Coinex, which consent may be withheld in Coinex’s sole discretion.
